Who May Adopt In Colorado?

In Colorado, any person who is 21 years or older may adopt. Married couples may adopt jointly.

When May Consent Be Signed?

Consent may be signed at any time after the birth of the child.

How Much Time Do the Birth Parents Have to Revoke Consent?

In Colorado, consent can only be revoked if the birth parents can prove “clear and convincing evidence that such relinquishment was obtained by fraud or duress”. This must be done within 90 days of signing the consent.

Does Colorado Have a Putative Father Registry?

No.

Does Colorado Allow the Biological Father to Give Consent Before the Child is Born?

No.

Can Adoptive Parents Advertise to Find Expectant Parents?

Yes. There are no statutes that address adoption advertising of this type.

Does Colorado Allow the Use of Facilitators?

No.

How Long Before Adoption Can Be Finalized?

6 months.

Which Expectant Mother Expenses Can Be Paid by the Adoptive Parents?

Medical and legal expenses may be paid. The statute is quite vague and other expenses may be allowed. All expenses must be approved by the court.

Can Out of State Residents Finalize in Colorado?

Yes.

Does Colorado Allow for Enforceable Open Adoption Agreements?

No. There are not any statutes in Colorado regarding open adoption agreements.
